WARRANTY CONDITIONS
§ 1.
1. Etex Building Materials Polska, a limited liability company with its registered office in Olkusz, entered into the commercial register maintained by the District Court for Kraków, 12th Commercial Division of the National Court Register under KRS number 0000114321, share capital PLN 109,500,000, REGON: 811145245, NIP: 8522097221 (hereinafter referred to as EBM Polska), grants, under the terms and conditions set out in these warranty conditions, a free, limited quality warranty for the products listed in the Warranty Card located on the back of this card, which are hereinafter referred to as the “Subject of the Warranty”.
2. The warranty is valid for a period of 60 months, starting from the date of issue of the Warranty Item to the Buyer or the date entered in the Warranty Card, if these dates are not the same.
3. The warranty is valid in the territory of the Republic of Poland.
4. The guarantee covers only and exclusively defects in the scope of the lack of resistance of the Subject of the guarantee to frost and water provided for in accordance with the standards indicated in the Product Cards, proven to have arisen as a result of production errors and/or defects in the material itself, which defects affect the quality of water resistance and frost resistance of the Subject of the guarantee. The Product Cards of the Subject of the Guarantee are available in the Equitone catalogue cards of the Subject of the guarantee published on the website www.equitone.pl (in the Technical Documents section)
5. The quality guarantee for the Subject of the guarantee is granted only for products used and installed in accordance with the principles of technology, construction art and standards and Product Cards to the extent and on the principles described in the Guarantee Conditions. The buyer and entities to whom he transferred the Subject of the guarantee for use are responsible for their compliance.
§ 2.
1. The guarantee entitles you to obtain from EBM Polska one of the following benefits:
a) repair of the Guaranteed Subject in whole or in part, to the extent that the defects were revealed, or
b) delivery of the Guarantee Subject free from defects in whole or in part, to the extent that the defects have been revealed, and in the event of withdrawal of the Guarantee Subject from EBM production, delivery of replacements for a given Guarantee Subject, understood as products available in the EBM range with the most similar features to the Goods subject to replacement, or
c) refund of the value of defective components of the Guarantee Subject up to their value on the date of purchase.
2. EBM Polska has the exclusive right to choose and determine the method of removing the defect of the Guarantee Subject, referred to in § 2 section 1 of these guarantee conditions.
3. Due to the fact that the Subject of the guarantee are construction materials, the buyer is obliged to prevent the increase of damage resulting from a possible defect of the Goods. At the same time, he is obliged to refrain from using the Goods in the construction process, if the claimed defect of the Goods could have been detected before the installation or other use of the Goods. EBM Polska does not bear the costs of dismantling and reassembling the Subject of the guarantee.
§ 3.
1. The condition for the implementation of warranty rights is:
a) delivery of the original completed warranty card issued by EBM Polska for the Warranty Subject,
b) reporting your rights under the guarantee within the period of its validity and no later than within 7 (seven) days from the date of detection of the defect in the Guaranteed Item,
c) use only materials approved by EBM Polska for assembly of the Warranty Subject, as listed in the Warranty Subject Assembly Instructions available on the website www.equitone.pl,
d) correct assembly of the Guaranteed Item in accordance with the Guaranteed Item Assembly Instructions available on the website www.equitone.pl and the principles indicated in §1 section 5 above,
e) payment of the full price for the Subject of the Warranty.
2. Defects of the Subject of the Guarantee should be reported to EBM Polska in writing, indicating the location, type and size of the defect. It is recommended to precede the written notification with information sent by fax or e-mail. The complaint should be accompanied by photos of the revealed defects of the Subject of the Guarantee.
3. The person entitled under the guarantee is obliged, under penalty of expiration of the guarantee rights, to make available to the representative of EBM Polska at any time the place where the defects of the Subject of the guarantee occurred, and agrees to prepare documentation from such on-site inspection, in particular to take photographs and use them in the complaint process.
4. EBM Polska will make every effort to examine the validity of the complaint within 14 days of its submission, counting from the date of receipt of the written complaint at the headquarters of EBM Polska. EBM Polska reserves the right to extend the deadline for considering the complaint, in particular if it is technologically justified by the type of defect or product, including in particular if it is necessary to examine the Subject of the guarantee by the manufacturer. EBM Polska will inform about the extended waiting time for considering the complaint within 14 days of receipt of the complaint, as referred to above.
5. If a complaint regarding the removal of a defect in the Subject of the Warranty has been accepted, EBM Polska undertakes to remove the defect within 30 days from the date of providing information about the acceptance of the complaint, unless circumstances beyond the control of EBM Polska occur that make it impossible to meet the above deadline or the parties enter into negotiations on another form of satisfying the complaint claims than repair or delivery of Goods free from defects.
6. No warranty claims shall be valid as long as the purchase price of the Warranty Item has not been paid in full.
§ 4.
Any liability of EBM Polska under the warranty is limited to the value of the Warranty Item indicated in its purchase document.
§ 5.
1. The warranty does not cover in particular:
a) natural discolouration, discolouration and colour differences of the Guaranteed Item caused by weather conditions or the action of other aggressive chemicals or normal properties of the material from which the Guaranteed Item was made,
b) due to the use of a natural binding component, i.e. cement, possible efflorescence on the Subject of the Warranty,
c) changes caused by use of the Warranty Subject, including in particular: • stains from window sills; • chemical, biological and mechanical damage such as: rust, dust, paint contamination; • damage caused by third parties; • damage resulting from force majeure.
2. The Buyer acknowledges that the Subject of the Guarantee will be exposed to changing weather conditions on the exposed wall, surface or facade, depending on the location, orientation, inclination and period of exposure. This may cause natural aging of the base material and coating (protective agent) caused by weather changes, as well as their fading caused by sunlight or exposure to other chemical factors, which changes are not covered by the guarantee.
§ 6.
In the event of unjustified complaints, the client shall bear the costs related to the complaint proceedings undertaken by EBM Polska.
§ 7.
The guarantee does not exclude, limit or suspend the rights of the person who purchased the Guaranteed Item from an entity other than EBM Polska, both in terms of guarantee and warranty, if such rights have been granted or are available under separate legal provisions.
